I know it was stupid but here goes: I was at a Marshalls (in California) and I swapped the tags on a clearance item with a non clearance item. The total difference was like . Loss prevention caught me, took me to a back room and asked for my driver’s license and phone number. They took down the information and told me they were not going to call the police. Instead, they just asked that I return the item and get my money back. The loss prevention guy said I couldn’t shop at that store anymore. But he didn’t tell me anything else. Like I said no police, nothing about attorneys, nothing about receiving any notices in the mail.
Where does that information go?
Can I not shop at ANY marshall’s or affiliated stores anymore?
Should I be concerned?
Will this be on a record somewhere?
And yes, I learned my lesson….
I should add that they didn’t photocopy my ID, just wrote the info down. And I did try calling the store back to talk to the same LP guy, but he wasn’t there anymore….

You could potentially receive a "fine" in the mail from the department store. I know KMart used to do this. (It was always an either/or situation: Either the shoplifter was prosecuted OR they sent a bill.) The loss prevention guy will forward your information to the main corporate office. Over $4, it seems likely that corporate won’t waste the time.
Stay out of that store. As far as going into other Marshall’s – you should be fine. Loss prevention doesn’t communicate with the loss prevention of other stores unless it is a really big situation like extremely high dollar amounts, a theft ring, etc.)

it doesnt go anywhere, they keep it in case u go back in. and no ur banned from the ONE marshalls. dont be worried, it wasnt even worth their time to stop you

Do you normally show your ID when you enter the store? No so shop at other stores and you will be fine, I wouldn’t apply for a job there though.

lol man that sucks…i knew someone that did something like that. But he was fined and stuff, yours seems a little less offensive so i wouldn’t worry about it being on your record. they’ll probably send your pic to other stores but to be honest i dont even think they did that…no worries, Just dont do it again. lol

dont worry about it. That just means if you get caught at THAT specific store doing the same thing again, they may call the police. You can still go to other marshalls (try not to steal because they could investigate and see that you have stolen from another branch and then press charges). But the information does not go anywhere. It is just used to make sure that if you get caught again they have a record of you doing it twice.

Consider it a first and final warning.
It probably won’t be recorded anywhere but at the Store where it was done…so as long as you don’t get in trouble there again, I think you’ll be fine.

You’re fine, dont worry about it. That info does get saved in logs, but thats it. Its not like you got caught cheating at a casino or anything. You will be fine to shop at other stores, but I would probably stay away from that Marshalls for about a year. No big deal. You switched price tags, everyone has done that once before. All they can do is what they did to you. Its not considered shoplifting, no matter what they tell you.

But, no… once you leave the store there is legally nothing they can do. Except for scare you into confessing… did they see you do it?? And you should not have given out your info without knowing what he was gonna do.

the store will have your information on file. if they see you in there or you try to exchange something or buy something and your name pops up, they could then call the police and make a report against you for trespassing. otherwise, there is no record of the incident anywhere else. But beware, store detectives talk to other stores detectives and so your face and name will be known by other stores in the area for sure. honesty really is the best policy.

This information won’t really go anywhere. It is remotely possible that they may share the information with other affiliated stores, but even then it would probably only be within a limited geographical area.
In all honesty, it is my guess that if you walked into that same store 5 years from now no one would even remember you. That’s not my advice – I’d stay out of there to avoid a trespass charge – but overall I’d say you got off easy and you have nothing to worry about since you learned your lesson.

THE INFORMATION DOESN’T GO TO THE POLICE, AND THERE IS NOTHING ON YOUR RECORD. YOU SHOULD NOT BE CONCERNED. YOU WERE NOT READ YOUR MIRANDA RIGHTS, ("YOU HAVE THE RIGHT TO REMAIN SILENT…") AND YOU WERE NOT OFFICAILLY CHARGED WITH ANYTHING. I KNOW THIS FROM DOING THE EXACT SAME THING, EXCEPT AT GARDEN RIDGE! Your picture goes up in the back and the store employee’s laugh at you when they see at McDonalds. However, if you ever go back into the store and someone is having a bad day; they will call the cops and report you for trespassing. Upon arrival, you stand a chance of being placed under apprehension.
I’ve been to Marshall’s before, you won’t be missing too much. Go ahead and find a new place to shop.

At Marshall’s they send out a mugshot of how you look in case you decide to come their way. I know at one of their stores they have a tendency of taking wrongdoers to the back of the store and taking turns slapping the cowboy sh!t out of them…

You won’t be in any trouble.
As long as you apologized the Loss Prevention guys will usually let you off the hook.
Just never shop at that particular store again, and never do it at their affiliates again.

They took your info down for their own records, so if you ever get caught again at any other Marshall’s they will get you in trouble next time. I would not go back to the store for at least a year. Consider yourself lucky.
